SWAN’S 2021 Legislative Efforts


As of October 8, 2021

 

House Bills:

HR 4350 National Defense Authorization Act 2022 (section numbers are those in the bill as passed by the SASC in July 2021)

Provisions of general interest

Sec 533 - Selective Service - Requires women to register with Selective Service

Sec 519E - Female Surface Warfare Officers (SWO) - Requires Independent assessment of female SWO retention, SWO demographics by gender, race/ethnicity, marital status, children, dual-military status and Command Climate analysis with reference to female SWO resignations.

Sec 559B - Prohibition of gender segregation at USMC boot camp and Officer Candidate School. Forbids gender-segregated platoons at boot camp and requires gender integration of all OCS training. (Long time SWAN goal)

Sec 559C - Ensuring Parental Guardianship Rights for Cadet and Midshipmen

Sec 563 - Report on Convening Courts for Non-Special Victims Felonies––Requires a report on the provisions of Military Justice Improvement and Increasing Prevention Act of 2021 (S.1520) with respect to non-special victim crime felonies.

Sec 571 - Collect information on female and minority participation at service academies and Senior NROTC

Sec 701 - Improvements to postpartum care for certain members

Sec 705 - Contraceptive copays covered for one year (SWAN wrote a coalition letter signed by eight other Military and Veterans Service organizations in support of this.)

 

General Changes to Military Justice System

            Sec 530 - Analysis of the uses of Non-Judicial Punishment

Sec 521 - Pre-trial agreements, separation in lieu of separation, etc.

 

UCMJ Articles:

            Sec 539C - Sexual Harassment - Establishes UCMJ Article 120d. Harassment doesn’t require direct contact. Can be written, on-line and using other electronic means

            Sec 539D - Stalking applies to dating and domestic partners.

            Sec 531-539F NDAA 2022 Independent Review Commission on Sexual Assault

This part of the NDAA bill contains many UCMJ changes including establishing Special Victims Prosecutors (SVP) and Special Victims Crimes (SVC), changes in who can prefer and refer charges to court -martial and who can enter into plea agreements for the government involving Special Victims Crimes. Those interested in more detailed information can read the House Version of NDAA 4350 available on-line available at Congress.gov.

HR.475 - Bring TRICARE into line with the Affordable Care Act for young adults under age 26 (not in NDAA)

S.2792 - National Defense Authorization Act of 2022

S.11-S.13 - Requires women to register for Selective Service and other Selective Service and Draft matters

Military Justice System General

S.563o - NJP - Analysis of NJP to include Diversity, Equality, and Inclusion (DEI) data as well as accused’s rank/paygrade

S.528 - Missing person reporting

S.529 - Art. 133 Conduct Unbecoming an Officer and a Gentleman. Strike the words “and a gentleman”

S.563 - Modification to Officers Authorized to Convene Special and General Courts for certain offenses under the UCMJ––Enacts provisions of Military Justice Improvement and Increasing Prevention Act of 2021 (S.1520) with respect certain felony offenses. (SWAN has long supported this).

Sec 530B-570 Independent Review Commission
